The Oyo State High Court in Ibadan has given the Peoples Democratic Party (PDP) the green light to proceed with its scheduled elective National Convention on November 15 and 16, 2025.
In a ruling delivered by Justice A. L. Akintola, the court granted an interim order allowing the convention to go ahead as planned in Ibadan, while also directing the Independent National Electoral Commission (INEC) to attend, monitor, and observe the exercise
The decision followed an ex-parte application filed by Folahan Adelabi against the PDP, its Acting National Chairman Umar Damagum, Governor Umaru Fintiri (in his capacity as chairman of the National Convention Organising Committee), and INEC.

Adelabi had asked the court to restrain the defendants from truncating, frustrating, or disrupting the PDP’s timetable, guidelines, and schedule of activities leading up to the convention.
“The court finds merit in the claimant’s motion ex-parte. The same succeeds and is hereby ordered as prayed,” the judge ruled. Consequently, the court granted all interim orders sought, restraining any interference with the PDP’s convention timetable and compelling the party and its officials to proceed with the planned exercise.
Justice Akintola also adjourned the hearing of the motion on notice for interlocutory injunction to November 10, 2025. The court’s order, dated November 3, 2025, was issued under the seal of the Oyo State High Court and signed by the Principal Registrar, S. O. Hammed.
With the ruling, the PDP is now legally cleared to conduct its national convention in Ibadan, where party delegates are expected to elect new national officers.
After hearing the application, Justice Akintola ruled in favour of the claimant, stating that he had successfully demonstrated the need for urgent judicial intervention.
Recall that Justice James Omotosho of the Federal High Court in Abuja had stopped the planned 2025 National Convention of the PDP until the party complies with the statutory requirements of the party, the Constitution, and the Electoral Act.
Delivering judgement last Friday in a suit filed by three aggrieved members of the party, the judge also restrained the Independent National Electoral Commission (INEC) from accepting a report on the outcome of any national convention of the party without following the due process of the law, as well as its guidelines and regulations.
The judge held that INEC is not entitled to give effect to the convention if a party has not done so in accordance with the Constitution, Electoral Act, and the guidelines/regulations of political parties.
The plaintiffs instituted the suit seeking to stop the planned November 15 and 16, 2025, National Convention of PDP scheduled for Ibadan in Oyo State, where new National Officers are expected to be elected on the grounds of breach of the party’s Constitution.
The nine defendants are, Independent National Electoral Commission (INEC), PDP, Samuel Anyanwu, National Secretary of the party, Umar Bature, National Organizing Secretary of the party, National Working Committee (NWC) and National Executive Committee (NEC) of the party, Ambassador Umar Iliya Damagum, Ali Odefa, and Emmanuel Ogidi.
